What is animal welfare?

Animal welfare in Australia is the legal and ethical framework that protects the wellbeing of domestic and wild animals. It is governed primarily by state and territory legislation rather than federal law, with national codes of practice and industry standards setting minimum requirements for specific contexts.

Each state and territory has its own Prevention of Cruelty to Animals Act or equivalent. The NSW Prevention of Cruelty to Animals Act 1979, the Victorian Prevention of Cruelty to Animals Act 1986, the Queensland Animal Care and Protection Act 2001, and equivalents in other jurisdictions all make it an offence to cause an animal unnecessary pain or suffering. Penalties can reach several hundred thousand dollars and prison sentences for the worst cases. RSPCA inspectors hold delegated powers to investigate alleged cruelty in most states.

Specific industries operate under codes and standards. The Australian Animal Welfare Standards and Guidelines cover land transport of livestock, sheep, cattle, poultry, and other species. The live export industry is regulated under the Australian Standards for the Export of Livestock (ASEL) and the Exporter Supply Chain Assurance System (ESCAS), with the Albanese government's commitment to phase out live sheep export by sea by 1 May 2028. The Model Code of Practice for the Welfare of Animals in Research and Teaching governs scientific use of animals.

Wildlife protection is a separate regime. Native animals are protected under federal and state environmental laws, with permits required for interaction beyond ordinary observation. The Australian Wildlife Conservancy, Bush Heritage Australia, Zoos Victoria, and Taronga Conservation Society operate extensive wildlife sanctuaries and captive breeding programmes for threatened species. Pet ownership is high (about 28.7 million pets across 6.9 million Australian households in 2022) and is supported by state-based registration, microchipping, and responsible-ownership campaigns. About 300,000 dogs and cats are surrendered to shelters each year, prompting ongoing community campaigns for desexing, registration, and adoption rather than purchase from breeders.
